How Liability Is Determined In Georgia

When it comes to determining liability in a car wreck, Georgia follows a “fault” system, meaning the at-fault driver is liable for any personal injuries or property damage that resulted from the accident. In such cases, the at-fault driver’s insurance is looked to first when satisfying this liability.

In many cases, common sense will tell you which driver was driving irresponsibly; for instance, when one driver runs a red light, runs a stop sign or turns left in front of an oncoming vehicle, that driver is at fault.

In injury accidents, the police will usually be called to the scene, and they will file an accident report. Sometimes, the police report will clearly state an officer’s opinion and that one of the drivers violated a traffic law and caused the accident. Other times, the report will not be as clear.

Any mention of a traffic violation or carelessness in the police report can be strong evidence and point towards an “at-fault” driver.

Certain types of car accidents leave little or no doubt that a driver is 99 percent or 100 percent at fault. Such accidents include rear-end collisions, left-turn accidents and crashes involving the running of a red light (when it can be proven with camera footage).
